Terms and Conditions



All prices are in Australian dollars ($AUD) and include GST. We take great care to try and avoid errors in pricing and product information. If mistakes occur we reserve the right to correct them.


Payment Method

We accept the following methods of payment: credit card (Visa, Mastercard and Amex only), direct deposit into our bank account or cash.





Furniture lay-bys require a deposit of 35% of the total amount. Full payment is required within 6 months of paying the deposit. We will be in regular communication regarding payment. A termination fee of 20% applies if you change your mind on a furniture lay-by. We will hold your furniture for you free of charge for 6 months. After 6 months a weekly storage fee of $50 applies.


Accessory lay-bys require a deposit of 35% of the total amount. Full payment is required within 3 months of paying the deposit. We will be in regular communication regarding payment. If you change your mind following payment of the deposit, we are happy to offer an exchange or credit note within 7 days.

If after 6 months full payment is not received the goods will be returned to stock and your full deposit will be forfeited.


Shipping and Handling

We deliver to all metropolitan areas within Australia. If the products that you have purchased are in stock they will be dispatched from our warehouse within the agreed timeframe (usually within 7 business days from receipt of payment). After dispatch, shipping time to most capital cities is usually 3-4 business days. Dates are estimates only. Deliveries within Brisbane are made on Mondays and Wednesdays. You can choose a 4 hour window in the AM or PM and you will be called by the delivery company 30 minutes before they arrive.

If the products you have purchased are out of stock delivery times can be delayed due to changes in shipping schedules, carrier delays and overseas suppliers changing dates. Delivery charges vary depending on your address. We will confirm your delivery fee when you buy your furniture. The charge is for ground floor, easy access properties only. Additional delivery costs will apply for difficult access. The delivery charge does not include unpacking or removal of materials, or rearranging of furniture. We can offer a VIP service if you need this to be done.


Free Shipping of Armadillo and Co Rugs in Queensland

We offer free shipping to any location in Queensland for any Armadillo purchase of $250 or more. This free service is a commercial courier service available during business hours (Monday – Friday, 9am – 5pm). A dispatch notice will be emailed to you with an estimated day of delivery but an exact time will not be provided. If no one will be home on the day of delivery you can opt to give us authority to leave your goods in a secure place on your property. Otherwise a calling card will be left and a more appropriate time can be arranged with the courier company. For deliveries of Armadillo and Co Rugs outside of Queensland, a $50 delivery fee is applied.


Furniture collection from our warehouse – Brisbane only

All furniture will be inspected and signed off before customers arrive for collection. The customer is required to look at all furniture when it is handed over to make sure it is not faulty. The Modern Furniture Store is not liable for any damage that occurs after the furniture has been collected.



Most of our furniture is delivered in one piece. A few items such as desk and floor lamps will need assembly. The Modern Furniture Store is not liable for any damage that occurs during assembly or as a result of being assembled incorrectly.


Returns and Exchanges

Furniture - faulty within warranty

All furniture is inspected before leaving our warehouse, customers are responsible for unpacking and inspecting all of the components of their furniture upon delivery. If there are any problems or damages please note these on the delivery docket and advise our Brisbane, Sydney or Melbourne store within 24 hours. If your furniture is faulty or an incorrect timber, material or colour we will replace it immediately. If we cannot replace it, we will refund you in full including the delivery charge.


Furniture purchased instore or sight unseen - change of mind

Customers are responsible for making sure furniture will fit through doors, up stairwells and in lifts. Please also make sure the furniture you purchase is suitable for your room. If you change your mind and return your furniture in original, unmarked condition and packaging within 7 days we will exchange it for another piece or offer you a credit note to the value of the goods only. The original delivery charges will not be refunded and the customer is required to pay for the delivery cost to get the furniture back to our warehouse and for getting the new furniture delivered using The Modern’s normal transport company. There will also be a $50 warehouse restocking fee.

There are no refunds for change of mind.

Accessories – faulty

 If your product is faulty please contact us within 7 days and we will exchange it, if it cannot be exchanged we offer a full refund.

If your full priced item is unsuitable and in original condition with original packaging and the receipt, we will offer an exchange or a credit note within 7 days of purchase. If you cancel a lay-by or change your mind following payment of the deposit, we are happy to offer an exchange or credit note within 7 days of purchase.


Our Furniture Guarantee

We provide a two-year warranty on all products which can be shown to be materially defective. The Guarantee is a structural warranty and does not extend to upholstery or foam or for normal wear and tear. The warranty will only apply to products that have been used in their intended manner and do not show signs of misuse. Further the warranty does not cover variations in the colour or grain of timber and leather and variations in the colour of upholstery fabric as these may differ from batch to batch from our suppliers. The warranty only extends to products used for residential applications.


Colour and grain variation timber leather and fabric

Our furniture is made of natural timbers (mainly solid European Oak, Ash, Birch and Elm) and full grain leather. As with any natural product there may be natural variations and slight imperfections in grains and colours. There may also be slight colour variations in the fabric swatches and fabrics of our sofas due to variations in dye batches during production.

Furniture will respond to environmental conditions. Please avoid extreme variation in temperature and humidity. Avoid direct sun, UV light, contact with heaters, liquid and sharp objects. Do not drag your furniture across the floor.

Floor stock

Please be aware that if an item is sold off the shop floor or is discounted more than 15% it is sold ‘as is’. Please check all goods carefully to ensure you are happy with the condition of the item at the time of purchase.


Gift vouchers

Gift vouchers for The Modern Furniture Store can be purchased either instore or over the phone. All gift vouchers can be mailed free of charge and used on multiple purchases. Gift vouchers are valid for 12 months from the date of purchase, no change can be given. Any remaining balance will remain as store credit.


Privacy Policy

We are committed to protecting your privacy and we will only use the information that we collect about you lawfully. We collect information about you for 2 reasons: firstly to process your order and second, to provide you with the best possible service. We will not pass your information onto a second party and we will give you the chance to unsubscribe from any marketing emails from us.

The type of information we will collect about you includes your name, address, phone number, email address and/or credit/debit card details. We will never collect sensitive information about you without your explicit consent and we always dispose of credit card details after your transaction has been made. The information we hold will be accurate and up to date. You can check this information by emailing us. If you find any inaccuracies with the information we hold we will delete or correct it promptly.

We may use technology to track the patterns of behavior of visitors to our website. This can include using a ‘cookie’ which will be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.
